APP TERMS OF USE & END USER LICENSE AGREEMENT (EULA)

These App Terms of Use and End User License Agreement (“Terms”) govern your use of the Blue Tees Golf mobile application (the “App”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, you must not use the App.

2. Eligibility

You must be at least 18 years old, or have permission from a parent or legal guardian, to use the App.
You are responsible for ensuring that your use of the App complies with all applicable laws.

3. License to Use the App
We grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on a personal device that you own or control, solely for your personal, non-commercial use.
You may not:

  • Copy, modify, or create derivative works of the App
  • Reverse engineer, decompile, or attempt to extract source code
  • Use the App for unlawful or unauthorised purposes
  • Rent, lease, sell, sublicense, or redistribute the App

All rights not expressly granted are reserved by Blue Tees Golf.

4. Ownership & Intellectual Property
The App, including all software, content, trademarks, and intellectual property, is owned by or licensed to Blue Tees Golf.
Nothing in these Terms transfers ownership of any intellectual property rights to you.

5. User Accounts
Some features of the App may require you to create an account.
You agree to:

  • Provide accurate and current information
  • Keep your login credentials secure
  • Notify us immediately of unauthorised account use

You are responsible for all activity that occurs under your account.

6. Connected Products & Data
The App may connect to Blue Tees Golf hardware products and collect usage data to enable features, performance tracking, and product improvements.
Use of connected products may require:

  • Compatible hardware
  • Internet connectivity
  • Firmware or App updates

We do not guarantee uninterrupted connectivity or compatibility with all devices.

7. Subscriptions & Paid Features (If Applicable)
Some App features may require a paid subscription.
If you purchase a subscription:

  • Payment will be charged through the App Store or Google Play
  • Subscriptions auto-renew unless cancelled before the renewal date
  • You manage subscriptions through your app store account

Refunds for subscriptions are subject to the policies of the relevant app store and applicable law.

8. Updates & Changes to the App
We may update, modify, or discontinue features of the App at any time.
You may be required to install updates to continue using the App.
We are not obligated to maintain or support any specific version of the App.

9. Acceptable Use
You must not use the App to:

  • Violate any laws or regulations
  • Infringe intellectual property rights
  • Upload malicious code or interfere with App functionality
  • Misuse or manipulate data or services

We may suspend or terminate your access if you breach these Terms.

10. Termination
We may suspend or terminate your access to the App at any time if you:

  • Breach these Terms
  • Use the App unlawfully
  • Misuse connected products or services

Upon termination, your licence to use the App will immediately end.

11. Disclaimer of Warranties
The App is provided “as is” and “as available”.
We do not guarantee that the App will be uninterrupted, error-free, or compatible with all devices.
Nothing in these Terms affects your statutory rights under UK law.

12. Limitation of Liability
Nothing in these Terms limits or excludes liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded under law

Subject to the above, Blue Tees Golf shall not be liable for indirect, incidental, or consequential losses, including loss of data, revenue, or profits.

13. Data Protection
Your use of the App is subject to our Privacy & Cookie Policy, which explains how we collect and process personal data in accordance with UK GDPR.

14. Third-Party Services
The App may integrate with third-party services or platforms. We are not responsible for third-party content, functionality, or availability.
Your use of third-party services is subject to their own terms and policies.

15. Changes to These Terms
We may update these Terms from time to time. Changes will be effective when posted within the App or on our website.
Your continued use of the App constitutes acceptance of the updated Terms.

16. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction.
